Submission into Identity Protections for Children

An inquiry into identity protections for proceedings involving children was announced earlier this year.

The inquiry has been established to consider the existing identity protections for any accused person in the Children’s Court or in proceedings under the Children (Criminal Proceedings) Act 1987.

Children’s privacy is children’s safety. Fams are presently pulling together a submission for this inquiry. Aligned to our support of the Child Safe Standards, our key advocacy centres on:

  1. Children (where age-appropriate) have a say in decisions about disclosure, supported by legal representatives and child advocates.
  2. Considerations of digital risks and digital permanency that weren’t consider when these legislative frameworks and safeguards were first established
